Terms of Service



Acceptance Of Terms


The first time a customer logs into an account will be deemed to constitute acceptance of the terms, conditions, rules and regulations of SuppleHost.com. The rights and responsibilities conferred by acceptance of this agreement are non-transferable.


System Security


Keep all passwords confidential. We cannot be responsible for any loss of data or interruption of service resulting from the customer sharing his/her/their password. Unless our records indicate that your account/files have been maliciously accessed you will be held responsible for all activity in your account or under your login/password. If your password has been lost, stolen or otherwise compromised, please contact SuppleHost.com immediatelly.


Limitation On Liability


SuppleHost.com's services are provided on an "as is, as available" basis and no warranty, expressed or implied, including but not limited to those of merchantability or fitness for a particular purpose, is made with respect to SuppleHost.com services. In addition, SuppleHost.com makes no guarantee regarding availability of ANY services, including but not limited to connectivity or system functionality or malfunctionality.


Reselling Hosting Services


By reselling hosting services, with or without consent of SuppleHost.com (a division of SuppleHoldings, Inc.), you confirm that you have read and accepted this Terms Of Service, understand that free support is provided to you but under no circumstances directly for your users, guarantee that all your users will be aware of the limitations listed herein, and agree that you will be responsible, including legal and financial responsibility, for all user's faults and/or misbehaves resulting from their activity on, with, toward, or in regard to SuppleHost.com hosting servers, other equipment, software, and staff.


99.9% Uptime Guarantee


This 99.9% uptime guarantee applies to any SuppleHost.com client in good financial standing with SuppleHost.com at the time of a service outage.

SuppleHost.com endeavors to have the content of your web site available for HTTP access by any party in the world 99.9% of the time. Downtime (unavailability) is defined as 100% packet loss between SuppleHost.com and backbone providers.

In the event that your web site is not available for more than 99.9%, SuppleHost.com will credit the following month's service fee as follows:

 Monthly Uptime  Credit
 95% to 99.8%  10% of base hosting fee 
 90% to 94.9%  25% of base hosting fee
 below 90%  50% of base hosting fee

Credits shall not be provided to you in the event that you have any outage resulting from:

  • scheduled maintenance as posted from time to time at SuppleHost.com;
  • your behavior or the performance or failure of your equipment, facilities or applications;
  • circumstances beyond SuppleHost.com's reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of interruption or delay in telecommunications or third party services, including DNS propagation, domain name registration/transfer, failure of third party software or hardware or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of your web site.

In order to receive a credit for downtime, customer should notify SuppleHost.com providing information about exact time period when the outage took place. In order to be considered, such notification should be submitted during the outage or within 7 days after the outage. If the outage can not be confirmed by SuppleHost.com records, an independent third-party proof is required.


Price Freeze Guarantee


SuppleHost.com guarantees, for as long as you are a contiunous client in good financial standing and you keep renewing your contract for web hosting service, that you get the minimum rate between initial rate you were given, and the current publically offered rate. If your web hosting package gets upgraded with new features such as more web space or bandwidth we will add these additional new services to your account without additional setup or recurring fees.


15 Days Money Back Guarantee


At SuppleHost.com, customer satisfaction is our main priority! Each of SuppleHost.com's services carry a 15 days money back guarantee. If you are not completely satisfied with our services within the first 15 days of usage, you will be given a full refund of the monthly fees excluding setup fees, addons, overages, or domain name registration. Setup fee will be retroactively charged if waived or discounted in the original charge. Setup fees are only refundable if the account order is canceled prior to activation. In order to receive a refund you must contact SuppleHost.com within the first 15 days following your account activation. No refunds are available after the 15th day. No refunds are available for accounts cancelled because of violating SuppleHost.com Terms of Service.


Cancellation


The customer must explicitly telephone, email or mail in a request for cancellation. You must expressly cancel the service; inactive but non-cancelled accounts will continue to be billed.


Acceptable Usage Policy


It is SuppleHost.com's goal to protect network resources, preserve the privacy and security of SupleHost.com's and our customers' accounts and networks, and maximize the utility of SuppleHost.com and the Internet.

All of the following are expressly prohibited and may
RESULT IN SERVICE TERMINATION, PROSECUTION, AND/OR A FINE:

  • Any attempts to gain access to another customer's account or system account.
  • Use of service in such a way as to willfully or negligently burden our servers disk storage, CPU, network or other resources or to effectively use SuppleHost.com's resources to cause a "denial of service" (DoS) for other SuppleHost.com customers or those connected to other systems or servers on the network, or third parties.
  • Willful or malicious attacks on another system or server.
  • Instigating an attack.
  • Consistent offensive or disruptive behavior toward SuppleHost.com's personnel.
  • Performing packet sniffing on or within our network.
  • Packet flooding on or within our network.
  • Sending unsolicited bulk e-mail (spam) from SuppleHost.com servers, or referring a domain hosted at SuppleHost.com servers.
  • Use of web hosting accounts as shell accounts.
  • Use of port forwarders, redirectors, IRC bots, or other software that generates or causes traffic different from incoming web traffic at TCP ports 80 and/or 443.
  • Adult content, or links to adult content.
  • Lack of Administration leaving common exploits open to vulnerability. Customers of the SuppleHost.com are responsible for educating themselves and configuring their accounts with at least basic security. Should customer's account be violated, the customer is responsible for prompt reporting the violation and then fixing the problem.
  • Performing any act that is prohibited under common law or the statutes or regulations of the State of Maryland, the United States of America, or under any applicable international convention.
  • Publishing any material that violates any applicable copyright, patent or trademark law or convention.
  • Any actions deemed by Management of SuppleHost.com to be damaging to the reputation of SuppleHost.com or its partners.
  • Any actions deemed by Management of SuppleHost.com to be damaging to its ability to service its customers.
  • Users are prohibited from interfering or attempting to interfere with service to any other user, host, or network on the Internet ("denial of service (DoS) attacks"). Examples of such prohibited activity include without limitation:
    • sending or receiving massive quantities of data (i.e. "flooding" with ICMP, SMTP, or any other type of traffic that exceeds accepted norms of size and/or frequency) with the intent of filling circuits, overloading systems, and/or crashing hosts,
    • attempting to attack or disable any user, host, or site, or
    • using, distributing, or propagating any type of program, script, or command designed to interfere with the use, functionality, or connectivity of any Internet user, host, system, or site (for example, by propagating messages, via e-mail, Usenet posting, or otherwise, that contain computer worms, viruses, control characters or Trojan horses).
  • Users are prohibited from intentionally or negligently injecting false data into the Internet, for instance in the form of bad routing information (including but not limited to the announcing of networks owned by someone else or reserved by the IANA) or incorrect DNS information.

As a result of not following the Acceptable Usage Policy, there may be a $500 fine, a mandatory 24 hour disruption of service per incident, termination of services, and possible legal consequences.

SuppleHost.com's procedure is to deal with each net-abuse case on an individual basis, based on an in-depth investigation and a determination of the severity.


Miscellaneous


SuppleHost.com will take action against any parties found in violation of these Terms of Service. SuppleHost.com reserves the right to terminate service at any time and without warning when a violation of our Terms of Service has occurred.

Any complaints regarding prohibited use or other abuse of the SuppleHost.com services, including violations of this Acceptable Usage Policy, should be sent via e-mail to SuppleHost.com at: abuse@supplehost.com. Please include all applicable information that will assist SuppleHost.com in investigating the complaint, including all applicable headerlines of forwarded messages, traces, and logs.
